Data Protection and GDPR
The EU’s General Data Protection Regulation (GDPR) is one of the central legal frameworks for the use of AI in web design and website creation. This applies particularly when the collection or processing of personal data plays a role. As part of the transparency obligation, website users must be informed that AI is being used on the website – for example, in chatbots or personalized recommendations.
If personal data is involved, the website operator must always obtain the user’s explicit consent to collect and process this data. Furthermore, the user must be given the opportunity to revoke any consent given to the collection and processing of their data.
The collected data may only be used for the intended purpose. If external AI services (e.g., OpenAI or Google) are used, a data processing agreement must be in place that regulates the handling of the collected data.
