(hereinafter referred to as “I” or “the operator”)

For some of the data processing activities listed below, in addition to the operator of this website, my respective cooperation partners are also jointly responsible under data protection law. You can therefore exercise certain rights directly with the respective cooperation partner. You can find corresponding information in the relevant section of this privacy policy.

My websites are operated on server systems of Goneo Internet GmbH, Marienwall 27, 32423 Minden, Germany, https://goneo.de, in a data center in Frankfurt am Main. As part of our collaboration, we do not share any personal data about your visit to our website directly with Goneo. However, it may happen that Goneo, e.g., during maintenance work, at least potentially gains access to personal data. Appropriate data protection agreements with Goneo ensure that your personal data is protected.

When you access my website, various information about your visit is collected. This information includes usage data such as the web pages you visit, the content you read, access times, device information, information about your operating system and web browser, and IP addresses. If, in addition to simply accessing my website, you also use services such as a contact form, a comment function, or another function that requires you to enter your data on my website, further information will be collected and processed in addition to the data already mentioned. This includes inventory data such as your name or address, contact details such as your telephone number or email address, and content data such as text entered or media sent.

Contact Forms

If you would like to contact me, you can use the contact forms on my website. If you do so, I will need the following data categories from you: name, email address, your message. You also have the option of optionally entering the following data categories: the name of your company, your telephone number, and other information. If you contact me, your data may be stored in a CRM (Customer Relationship Management System) or another administration system. As soon as your inquiry data is no longer required to fulfill the order or contract, it will be blocked and deleted after the respective retention periods have expired, unless other legal requirements require the longer retention of your data.

To protect the security of your data during transmission, my website uses state-of-the-art encryption methods.

Newsletter

If you use the option to subscribe or register for a newsletter on my website, you agree to receive the newsletter and to the processing of your relevant personal data. As a general rule, I only send newsletters, emails, or other electronic information with your prior consent and/or within the framework of legal regulations.

My newsletter contains exclusively information about my services, relevant offers from third-party providers, and myself. The dispatch of my newsletter and any performance measurement carried out after the newsletter has been sent are based on your consent in accordance with Art. 6 (1) (a) and Art. 7 GDPR in conjunction with Section 7 (2) No. 3 of the German Unfair Competition Act (UWG) and/or on the basis of legal permission in accordance with Section 7 (3) of the UWG.

Registration for my newsletter is carried out using the so-called double opt-in procedure. This means that you first enter your email address to register for the newsletter. You may optionally be asked to enter your first and last name so that I can address you personally. In a second step, you will receive an email to the address you provided containing a link to confirm your registration. You will only successfully subscribe to my newsletter after activating your registration. Subscriptions to my newsletter are logged for the sake of legality.

My newsletter is sent using the mailing service provider MailChimp (http://www.mailchimp.com) of the US company Rocket Science Group, LLC, 675 Ponce De Leon Ave NE #5000, Atlanta, GA 30308, USA. MailChimp uses its own privacy policy for handling personal data, which you can view at https://mailchimp.com/legal/privacy/. MailChimp is certified under the Privacy Shield Agreement and guarantees compliance with European data protection standards. I use MailChimp based on my legitimate interest and a data processing agreement pursuant to Art. 28 (3) (1) GDPR. Please note that MailChimp may use your data in an anonymized form (i.e., without assigning it to a specific user) to optimize its own services, ensure the correct presentation of the newsletter, or conduct statistical analyses. MailChimp will not use your personal data to contact you independently for its own purposes or to share it with third parties.

You have the option to unsubscribe from my newsletter or cancel your subscription to my newsletter at any time. For this purpose, each newsletter contains a link at the bottom of the content. You also have the option of unsubscribing from my newsletter by email, telex, or telephone. Please note that I am legally entitled to retain the email address you provided when registering for my newsletter for up to three years after you unsubscribe from the newsletter – for example, to legally prove a previously given consent. However, the corresponding data will be retained solely to ensure legal certainty.

Technically Required Data

If you access my website without logging in or registering, I and/or my host automatically collect information of a general nature. The collection and processing of this data is based on our legitimate interest within the meaning of Art. 6 (1) (f) GDPR. The information collected (so-called server log files) includes the type of web browser you use, the operating system you use, the domain name of your Internet service provider, the IP address, the time and duration of access, the pages requested, the amount of data transferred, and the referrer URL of the previously visited website. This information is exclusively information that is not used to draw conclusions about you personally. This information is technically necessary to correctly deliver the website content you request and is mandatory when using the Internet. Anonymized information of this type may be statistically evaluated to optimize my website and the technology behind it. The purpose of processing this information is to provide my online offerings, including their functions and content, to measure the reach of my offerings, to answer inquiries, to communicate with you, and, if necessary, to implement security measures.

Cookies

Like many other websites, my website uses so-called “cookies.” Cookies are small text files that are transferred from a web server to your computer. This automatically records certain data, such as your IP address, browser used, operating system, your computer, and your internet connection. Temporary cookies, or so-called “session cookies,” contain information related to your current visit to my website. Temporary cookies are deleted after your visit to my website or when you close your browser. Permanent cookies usually contain information about your login status or your interests on my website, which are used for reach measurement or other marketing purposes. Permanent cookies remain stored on your computer even after you close your browser. Cookies cannot be used to start programs or transmit viruses to a computer. Using the information contained in cookies, I can make navigation easier for you and ensure that my website is displayed correctly. Under no circumstances will the data I process be passed on to third parties or linked to personal data without your consent. Of course, you can generally view my website without cookies. Internet browsers are generally set to accept cookies. You can deactivate the use of cookies at any time via your browser settings. You also have the option of deleting cookies that have already been stored on your computer. Please use the help function of your Internet browser to find out how you can change your cookie settings or delete cookies that have already been stored. If you wish to generally object to the use of cookies for marketing purposes, you can do so with various online service providers – for example, https://www.aboutads.info/choices in the US or https://www.youronlinechoices.com in the EU.

Please note that individual functions of my website may not work if you have deactivated the use of cookies.

This website does not use any external analytics or marketing services that store data outside of this website. Matomo is used to collect and analyze website traffic. You can prevent Matomo from tracking your website traffic by clicking here: [matomo_opt_out].

There are currently no third-party services integrated into this website.

Your data will only be shared with third parties if this is permitted or required by European data protection law. This is the case, for example, if you have expressly consented to the sharing of your data and/or if the sharing is necessary for the performance of the contract. Sharing your data is also permissible under data protection law if the enforcement of provisions of other laws (e.g., criminal law provisions) requires the sharing and there is nothing to prevent this sharing from a data protection perspective. Sharing your data is also legal if I have a legitimate interest in sharing the relevant information (e.g., when awarding a contract to a third party, when using an agent, or with a web host). Sharing your data within the framework of a contract processing agreement is carried out exclusively on the basis of Art. 28 GDPR. You can rest assured that the possible sharing of personal data to third parties will always be reviewed in advance under data protection law.

If I process personal data in a third country (i.e., a country outside the European Union or the European Economic Area) or have it processed by third parties, e.g., in the context of using a service, this will be done solely for the purpose of fulfilling my contractual obligations, with your consent, or based on a corresponding legal obligation. The transfer or processing of your data to third countries will only occur if such transfer or processing is legally and/or contractually lawful, and if the special requirements under Art. 44 et seq. GDPR are met. Special requirements exist, for example, if the third country is officially recognized as having a data protection level equivalent to that of the EU. Relevant guarantees or the agreement of officially recognized contractual obligations (so-called standard contractual clauses) also constitute special requirements for the transfer of data to third countries.

At this point, I would like to briefly inform you about the data protection rights you can exercise with regard to me.

Right to Information / Right to Correction

You have the right to receive information about your personal data stored by me at any time or to request copies of this data. Please send me an email to mail@sebastian-klammer.de. Only correct data about you may be processed. If you discover – for example, by exercising your right to information – that data about you is incorrect or incomplete, or has become incorrect/incomplete, I am generally obliged to correct it immediately.

Right to Deletion / Right to Blocking

I process your data only for the purposes stated in this privacy policy. This data is generally only required to process the data processing you have requested (e.g., processing your message, reviewing your request). In some cases, I may be legally obligated to retain your data for a certain period of time. If I no longer need your data during this period, it will be blocked or its processing restricted. You have the right to request the immediate deletion of your data or to request that the processing of your data be restricted. You also have the right to have the data I have stored about you transmitted to yourself or to another responsible party before it is deleted.

Right of Objection / Right of Withdrawal

If you are legally entitled to object to the data processing described in this Privacy Policy, you will be informed of this at the relevant point. You also have the opportunity to exercise your objection at the relevant points. In addition, you have the right to revoke any consent you have already given to the collection or processing of your data with future effect, or to object to the future collection and processing of your personal data at any time. This objection can be made in particular if the processing of your data serves the purpose of direct marketing.

You can contact the data protection officer directly via the following email address: mail@sebastian-klammer.de.

If you do not agree with how I handle your personal data, you can file a complaint with the relevant supervisory authority.

I reserve the right to occasionally adapt parts of this Privacy Policy to ensure that it always complies with current legal requirements or to implement changes to my services in the Privacy Policy, e.g., when introducing new services. The new Privacy Policy will then apply to your next visit. If your prior consent is required for the introduction of a new service, you will be informed accordingly and asked for your consent. This Privacy Policy is dated May 15, 2024.
