Artificial intelligence such as ChatGPT or generative AI for creating images, videos, or other content can greatly simplify the creation of your website. For example, they can create content for your new website or even contribute to the web design of your new website. However, there are some important points to consider when using AI in web design \u2013 both from a technical and ethical perspective.<\/p>\n
Artificial intelligence can help with website creation in many ways \u2013 from planning to the final design. The most important uses are:<\/p>\n
The EU’s General Data Protection Regulation (GDPR) is one of the central legal frameworks for the use of AI in web design and website creation. This applies particularly when the collection or processing of personal data plays a role. As part of the transparency obligation, website users must be informed that AI is being used on the website \u2013 for example, in chatbots or personalized recommendations.<\/p>\n
If personal data is involved, the website operator must always obtain the user’s explicit consent to collect and process this data. Furthermore, the user must be given the opportunity to revoke any consent given to the collection and processing of their data.<\/p>\n
The collected data may only be used for the intended purpose. If external AI services (e.g., OpenAI or Google) are used, a data processing agreement must be in place that regulates the handling of the collected data.<\/p>\n
Users should always know when they are interacting with an AI and not with a human. For example, AI-generated texts, images, or chatbots are subject to mandatory labeling. Within this framework, the functionality of the AI \u200b\u200bmust be at least fundamentally explainable, especially when making critical decisions.<\/p>\n
It is important to note that the responsibility for the AI \u200b\u200bremains with the website operator! Incorrect decisions or discrimination by AI must be prevented or corrected.<\/p>\n
If AI creates content based on copyrighted works or information, this must be marked accordingly, and the consent of the respective author must be obtained. If a copyright infringement arises from the content created by AI (text, images, photos, graphics, audio files, or other media), the website operator is liable for this.<\/p>\n
Even if something is technically possible, it is not always right. The principles of fairness and non-discrimination also apply to the use of AI in web design: AI must not disadvantage, insult, discriminate against, or otherwise exclude any group. Responsible review of content created by AI is therefore mandatory in all cases.<\/p>\n
Furthermore, AI should not be used to manipulate people or human behavior\u2014for example, to produce fake news or deepfakes. AI should support people, not replace them\u2014especially when making sensitive decisions.<\/p>\n
Data security plays a crucial role when using AI in web design and website creation. It is important to ensure that the website and all data collected by or through it are protected from data leaks, misuse, and unauthorized access. Robust systems are also important in this context. The AI \u200b\u200bmust not crash or produce unpredictable results. AI models should be regularly reviewed and retrained if necessary.<\/p>\n
If you use artificial intelligence to create your website, generate website content, or interact with your users, it must be clearly defined what exactly the AI \u200b\u200bdoes, how which data is processed, and what rights the user has regarding their data.
